Terms of Service

Effective May 25, 2026.

x402-sms ("the service") is part of the tollkit.dev family of developer tools. By opting in to receive messages, or by using the API to send messages, you agree to these Terms of Service.

1. Service description

x402-sms is a transactional SMS delivery service. Messages are delivered via a Twilio verified toll-free number (+1 (888) 841-3236) to US recipients who have explicitly opted in to receive them.

2. Recipients

By opting in via /optin, you authorize x402-sms to deliver transactional messages to your phone number from developers using the platform. You may opt out at any time by replying STOP.

3. Developers (API users)

Developers using the API to send messages must attest, on every API call via the opt_in_attestation: true request parameter, that every recipient has explicitly consented to receive messages. Developers are responsible for obtaining and maintaining consent records under TCPA, CTIA, and applicable carrier rules. Operator may revoke API access from any developer found to be sending messages without consent.

4. Acceptable use

The service is for transactional content only. The following are prohibited and will be rejected at the API layer, the Twilio layer, or both:

• Marketing or promotional content
• Content related to S.H.A.F.T.-C (sex, hate, alcohol, firearms, tobacco, cannabis)
• Messages to recipients who have not consented
• Messages to non-US (non +1) phone numbers
• Content otherwise prohibited by Twilio's Messaging Policy or carrier rules

5. Message and data rates

Standard message and data rates from your carrier may apply.

6. Frequency

Message frequency varies based on developer activity, typically 1–10 messages per month per opted-in recipient.

7. Opt-out and help

Reply STOP to +1 (888) 841-3236 at any time. Twilio honors carrier-level opt-out keywords (STOP, UNSUBSCRIBE, CANCEL, END, QUIT). Reply HELP for help instructions.

8. Disclaimer of warranty

The service is provided "as is" and "as available" without warranty of any kind, express or implied. Operator does not warrant uninterrupted or error-free operation.

9. Limitation of liability

To the maximum extent permitted by law, operator is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

10. Changes to these terms

These Terms may be updated from time to time. Continued use of the service after changes are posted constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the United States.
